DS PRODUCTION (SAS) & DS FORMATION (SASU), version mise à jour le 8 septembre 2026 (remplace la version entrée en vigueur le 2 janvier 2021).
These terms of sale (hereinafter the "Terms of Sale") set out the terms and conditions under which the services offered via the websites www.craquezlecode.com, www.jecraquelecode.com and https://magali.dsproduction.learnybox.com (hereinafter: the "Services") are sold, as well as the rights and obligations of the parties in this context.
They are accessible and printable at any time via a direct link at the bottom of every page of the site, and, in the case of an online purchase, within the order form itself.
They may be supplemented, where applicable, by terms of use specific to certain Services. In the event of any contradiction, the specific terms take precedence over these general terms.
1.1 For the purposes of these terms, the following words have the meaning set out below:
Publisher: the company publishing this site, namely DS PRODUCTION and DS FORMATION, depending on the service concerned.
Site content: information of any kind present on the site as well as all downloadable or editable materials.
Client: any individual or legal entity who has agreed to these Terms of Sale and has paid the price of the service, or begun paying it according to a schedule and terms accepted by the publisher.
Professional client: a client whose business is registered with a trade register or equivalent and who received a prior quote from the publisher before contracting.
Individual client (consumer): an individual not registered with a trade register or equivalent, entering into the contract in their own name and on their own behalf.
Service: training, facilitation, support, conferences, private evenings, mentoring and other services provided by the publisher to the client.
Order: any order for services listed in the seller's price list, accepted by the seller, accompanied by full payment or any deposit provided for on the order form.
Force majeure: an exceptional, unforeseeable, irresistible event external to the parties within the meaning of article 1218 of the French Civil Code (for example: a pandemic, a natural disaster, an unforeseeable government decision). An internet connection failure or a malicious cyberattack do not, in themselves, constitute a case of force majeure; such situations are covered by the liability clause in article 14.
Start of contract performance: the contract is considered to have begun once the client has paid the price or deposit and has been given access to the service through the login credentials sent by the publisher.
1.2 The service offered is considered a service. The provision of any physical material as part of the training does not constitute a sale or transfer of ownership of goods.
2.1 These Terms of Sale apply as of right to the services provided by the publisher, namely DS PRODUCTION for the events part and DS FORMATION for the support, mentoring, training and coaching part, including, without limitation: the content of the site, online training courses, printed or downloadable materials, videos, visual materials of any kind, and audio materials.
2.2 They apply to all transactions carried out with the publisher, to the exclusion of any other terms.
2.3 They apply from the moment of subscription, which takes place on the date the order is accepted and paid for, either immediately or according to an accepted payment schedule.
2.4 Clicking to accept the Terms of Sale, confirming an online order, or paying an invoice by bank transfer, constitutes a purchase agreement having, between the parties, the same value as a handwritten signature.
2.5 These terms came into force on January 2, 2021 and were updated on September 8, 2026. The version in force is permanently available on the site.
2.6 The buyer declares having read these Terms of Sale and having accepted them before making a purchase.
3.1 Prior to any purchase, these Terms of Sale are provided to the buyer, who acknowledges having received them.
3.2 The following are provided to the buyer in a clear and understandable way: the essential characteristics of the service; the price of the service; the date or time frame by which DS PRODUCTION, for conferences or events, and DS FORMATION, for support, training, mentoring and coaching, undertake to perform the service; information relating to the identity of the provider, and its postal, telephone and electronic contact details.
3.3 The provider communicates to the client: its name or corporate name, the geographical address of its establishment, its telephone number and email address; the terms of payment and performance of the contract; the duration of the contract or the conditions for its termination.
3.4 The publisher provides the client with: its legal form and contact details; its registration number with the French Trade and Companies Register: DS PRODUCTION (SAS), SIRET 879 979 375 00018, intra-community VAT number FR08879979375; DS FORMATION (SASU), SIRET 920 157 310 00011, a training provider benefiting from the VAT exemption provided for in article 261-4-4° of the French General Tax Code; any specific terms, if applicable.
3.5 The publisher reminds users that placing any order for the Services listed on this site requires prior review of these Terms of Sale.
3.6 These Terms of Sale express the entirety of the parties' obligations. They are applicable from the time of subscription, with no time limit.
3.7 The Client is deemed to accept, without reservation, all of the provisions set out in these Terms of Sale.
3.8 A Client who does not accept amended Terms of Sale may not register on the site or access the Services. If they access them by any means whatsoever, DS PRODUCTION, for conferences and video recordings, or DS FORMATION, for training, coaching and support, may suspend that access without notice.
3.9 Any Client using the Services after amended Terms of Sale come into force is deemed to have accepted those amendments.
3.10 DS PRODUCTION and DS FORMATION reserve the right to amend these Terms of Sale at any time. The latest version published on the site prevails. Acceptance of the current Terms of Sale is required for each new order.
3.11 The Client acknowledges being in full possession of their legal, physical, mental and intellectual capacities to understand and apply these Terms of Sale.
4.1 Any order must be placed using the publisher's order forms. Any order received by the publisher is deemed firm and final; it entails full and complete adherence to and acceptance of these Terms of Sale and an obligation to pay for the services ordered.
4.2 The computerized records kept in the systems of DS PRODUCTION and DS FORMATION, or of any service provider of their choice, under reasonable security conditions, constitute proof of the orders and payments made, as well as of communications relating to the service.
5.1 For services requiring a prior quote, the sale is only considered final once the quote has been drawn up by the publisher and the client has confirmed acceptance of the order.
5.2 Quotes issued by the provider are valid for 15 days.
5.3 Any order placed by a professional is only valid if they have previously requested and returned a dated, signed and stamped quote, or one accompanied by proof of their business registration.
6.1 Unless expressly agreed otherwise, the service is performed digitally within a maximum of 2 business days from receipt of the order.
6.2 In the absence of a stated performance date, the publisher performs the service without undue delay and no later than 2 business days after the contract is concluded.
6.3 Should the publisher fail to perform its obligation by the agreed date, or failing that within 30 days of the contract being concluded, the client may terminate the contract under the conditions set out in articles L.216-2, L.216-3 and L.216-4 of the French Consumer Code, by registered letter with acknowledgment of receipt or in writing on any other durable medium, after having given the publisher formal notice to provide the service within a further reasonable period that has proven unsuccessful.
6.4 Prior to taking this step, a complaint must be sent to contact@jecraquelecode.com, with a copy to magali@craquezlecode.com.
6.5 The contract is considered terminated upon the publisher's receipt of the registered letter with acknowledgment of receipt informing it of this termination, unless the publisher has performed the service in the meantime.
6.6 The client may immediately terminate the contract where the publisher refuses to provide the service, or fails to perform its obligation by the agreed date, if that date constitutes, for the client, an essential condition of the contract resulting from the circumstances of its conclusion or from an express request made by the client before the contract was concluded.
6.7 The costs and risks related to such termination are borne exclusively by the publisher, under the terms of article 7 below.
6.8 An individual client, or a client who did not subscribe following a prior quote, may exercise their right of withdrawal under the conditions set out in article 8 below, using the form in Appendix 1.
7.1 The publisher will refund the individual client the full amount paid, without undue delay and no later than 14 days after being informed of the decision to withdraw from or terminate the contract. It is specified that tickets for the Craquez le Code national tour evenings are neither exchangeable nor refundable, except if the event is cancelled by the organizer; the client acknowledges taking due note of this before making their purchase.
7.2 In the event of a delayed refund, a penalty is owed by the publisher, in accordance with article L.242-4 of the French Consumer Code, equal to the legal interest rate if the refund is made no later than 10 days after the expiry of the above period, increased by 5 points between 10 and 20 days of delay, by 10 points between 20 and 30 days, by 20 points between 30 and 60 days, by 50 points between 60 and 90 days, then by a further 5 points per month of delay until the amount owed reaches the order amount, beyond which the legal interest rate applies again.
8.1 Legal right of withdrawal
In accordance with article L.221-18 of the French Consumer Code, for any online, off-premises, or doorstep subscription by an individual client, a 14-calendar-day withdrawal period runs from the date of subscription, without the client having to justify their decision or bear any penalties, except for the exceptions set out in article 8.2 below.
To exercise this right, the client sends the withdrawal form in Appendix 1, or any unambiguous statement, to contact@jecraquelecode.com.
8.2 Legal exceptions to the right of withdrawal
In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to:
a) digital content not supplied on a physical medium (online training, videos, audio) whose performance has begun after the client's express prior consent and their express waiver of their right of withdrawal, before the expiry of the 14-day period;
b) tickets for leisure events (events, shows) scheduled for a specific date or period.
For training courses and digital content, access to the platform or to a training module constitutes the start of performance with the client's express consent. When ordering, a checkbox, not pre-checked, is presented to the client worded as follows: "I request the immediate performance of the Service and I acknowledge that I lose my right of withdrawal once performance has begun." A client who checks this box and then accesses the service loses their right of withdrawal under the conditions provided for by law; a client who does not check it retains their 14-day right of withdrawal, and access to the training will only be opened to them once that period has expired, unless they later waive it in the same form.
8.3 Additional goodwill gesture (DS FORMATION training courses)
Independently of the legal right of withdrawal above, and as an optional commercial goodwill gesture, DS FORMATION may grant a client who has not accessed any training module within 7 days of subscribing (simply visiting the platform does not count as accessing a module) a refund of the amounts paid, less only the banking fees actually incurred by DS FORMATION for the transaction, up to a limit of 2% of the amount paid. This commercial option, distinct from the legal right of withdrawal, neither restricts nor replaces it, and may be withdrawn or modified at any time for the future.
8.4 Installment payment
In the event of installment payment, all installments must be paid to retain access to the entire training course. Any failure to pay results in the suspension of access until the situation is resolved. In the event of a second unpaid installment not resolved within 15 days of a formal notice, the file is passed to the publisher's debt collection agency for recovery of the full amount owed, plus the costs of managing the collection file.
8.5 Online withdrawal function
This function does not apply to purchases of any training course or digital content for which the client has checked the express waiver box provided for in article 8.2: in that case, the right of withdrawal has already been excluded from the moment access to the service was opened, and no online withdrawal function is required for that order.
Only in cases where the right of withdrawal remains open, meaning the client has not checked this box, or for any service to which the exception in article 8.2 does not apply, does the publisher provide the client, in their online account, with a directly accessible withdrawal function allowing them to notify their decision, in accordance with the legal requirements applicable to distance contracts concluded electronically.
9.1 Prices are firm and final. They are those appearing on the site on the day of the order, subject to any specific terms applicable to certain services.
9.2 They are expressed in euros, inclusive of all taxes for DS PRODUCTION, and exclusive of tax for DS FORMATION, the latter benefiting, as a training provider, from the VAT exemption provided for in article 261-4-4° of the French General Tax Code.
9.3 The publisher reserves the right to offer, at its sole discretion, promotional offers or price reductions at any time.
10.1 Unless specific terms expressly provide otherwise, payment of the price is made in full at the time of order. In the event of installment payment, a first installment is required at the time of order. Payments are only considered final once actually collected.
10.2 Payment is made by bank transfer or automatic direct debit. Stripe, the payment provider, alone retains the client's banking details for this purpose; no banking details are retained by the publisher.
10.3 The client guarantees to the publisher that they have the necessary authorizations to use the chosen payment method and undertakes to take the necessary steps so that the automatic direct debit can be carried out.
10.4 In the event of late payment under an installment payment plan, formal notice is sent to the client. For an individual client, if no resolution occurs within 8 days of this formal notice, all remaining amounts owed become immediately due. For a professional client, any late payment results, without prior formal notice, in the loss of the benefit of the payment term and the immediate payability of all amounts owed.
10.5 An invoice is accessible in the client's member area and is provided to them upon simple request.
10.6 In the event of failure to pay the agreed installments, the publisher reserves the right to immediately suspend access to the service.
10.7 In the event of non-payment, after a formal notice has proven unsuccessful, the publisher applies late interest at a rate of three times the legal interest rate.
10.8 In the event of collection proceedings, the client will bear a penalty clause of a flat amount equal to 10% of the amounts remaining due, with a minimum of €150, in addition to all collection costs incurred.
10.9 Under the "Becoming a Successful Entrepreneur" program, access to the "Access to the Craquez le Code evening" bonus only opens once the training has been paid in full.
11.1 All technical documents, products, drawings and photographs provided to clients remain the exclusive property of DS FORMATION for training courses, and of DS PRODUCTION for the events part, as the sole holders of the related intellectual property rights, and must be returned to them upon request. The CRAQUEZ LE CODE trademark has been registered with the INPI (French National Institute of Industrial Property); any unauthorized use of the name "CRAQUEZ LE CODE" will be subject to legal action seeking to stop the harm and obtain compensation proportionate to the duration of the use observed.
11.2 Clients undertake to make no use of these documents or of the trade name "CRAQUEZ LE CODE" likely to infringe the provider's intellectual property rights, and not to disclose them to third parties.
11.3 The pages accessible via this site, as well as all documents present and downloadable, in particular via hyperlinks, are the exclusive property of their owners, who also hold copyright in them.
11.4 Any unauthorized reproduction or reuse, in whole or in part, of the visual, documentary or audio elements of the site constitutes an infringement liable to prosecution.
11.5 The Client acknowledges that this site has no medical, therapeutic, legal or tax purpose, but has the sole purpose of offering assistance with the Client's personal and professional development and that of their business (depending on the programs chosen, the professional component may not be included).
11.6 The information provided does not in any way constitute professional, medical, psychological, financial or legal advice. The Client therefore waives any action seeking to hold the publisher liable for the effects, or lack of effects, resulting from the use of the products and information presented on this site.
The Client acknowledges and accepts that data collected on the site and on the computer systems of DS PRODUCTION and DS FORMATION serve as proof of the reality of the transactions carried out under these terms and constitute the main form of evidence admitted between the parties, in particular for calculating amounts owed.
13.1 The client is responsible for their personal commitment to using the Services, as well as for their availability to implement them. They undertake to develop the mindset necessary to achieve their goals and understand that the Services, involving both personal and professional development, leave them fully responsible for the decisions they make. The publisher may under no circumstances be held liable for the client's professional or personal decisions, or lack thereof, during or after the period of use of the Services. The client undertakes to acquire the skills necessary to progress while using the Services and to achieve autonomy.
13.2 Without prejudice to the other obligations provided for herein, the Client undertakes to comply with the following obligations.
13.3 In their use of the Services, the Client undertakes to comply with applicable laws and regulations and not to infringe the rights of third parties or public order.
13.4 The client is solely responsible for completing their own administrative, tax and social security formalities, as well as for paying any contributions, taxes or duties owed by them in connection with their use of the Services.
13.5 The publisher provides no information or advice relating to the obligations referred to in article 13.4; the Client must handle these matters personally, with no recourse against the publisher.
13.6 The client reviews on the site the characteristics and constraints, in particular technical ones, of the Services. They are solely responsible for their use of the Services and ensure they have a sufficient internet connection and suitable equipment.
13.7 The client is responsible for their attendance at workshops, webinars and other sessions, and ensures they have a sufficient connection on those dates.
13.8 The Client is solely responsible for the relationships they form with other clients and the information they share with them in connection with the Services; they exercise appropriate caution and judgment in these exchanges, observe the usual rules of politeness and courtesy, and refrain from harming others or seeking to manipulate them for personal gain.
13.9 The Client undertakes to provide the publisher with all information necessary for the proper performance of the Services and to actively cooperate to that end.
13.10 The Client is solely responsible for content of any kind (written, graphic, audiovisual or other, including the name or image they choose to identify themselves on the site) that they disseminate in connection with the Services (the "Content"). They guarantee that they hold all rights and authorizations necessary for its dissemination.
13.11 In the event the publisher is held liable or prosecuted for content disseminated by the client, the client shall indemnify and hold the publisher harmless from any judgment rendered against it.
13.12 The publisher prohibits unlawful Content that infringes public order, public morality or third-party rights, including in particular pornographic, obscene, indecent, shocking, defamatory, abusive, violent, racist, xenophobic or revisionist content, counterfeits, infringements of a third party's image or dignity, false or misleading content or content promoting unlawful or fraudulent activities, as well as content harmful to third-party computer systems (viruses, worms, Trojan horses, etc.) and any act of unfair competition. This list is not exhaustive.
13.13 The Client acknowledges that the Services offer an additional, but not alternative, solution to the means they otherwise use to achieve the same goal, and that this solution does not replace them.
13.14 The Client takes the necessary steps to save, by their own means, any information shared by the publisher that they deem useful, whether via the member area, by email or any other platform. Sharing content that is not meant to be saved, for confidentiality reasons, with a third party exposes its author to legal action.
13.15 The client undertakes to be present and punctual for appointments scheduled as part of the Services, whether in person or virtual. Any lateness on their part is deducted from the length of the session; any scheduled appointment not attended is forfeited, except in cases of force majeure or a prior specific agreement.
13.16 The client is strictly prohibited from using the Services for unlawful or fraudulent activities, or activities infringing the rights or safety of third parties, from gaining unauthorized access to a third party's computer system or carrying out any activity likely to harm, intercept or compromise the integrity of such a system, from sending unsolicited emails or commercially soliciting members of the DS PRODUCTION and DS FORMATION community, from carrying out manipulations intended to improve the search ranking of a third-party site, from taking advantage of the ignorance or credulity of other clients, or from participating, actively or passively, in any such act. The client is also strictly prohibited from using the Services for sales or advisory purposes, in particular relating to wellness, paramedical or medical matters.
13.17 Clients are strictly prohibited from copying or appropriating, for their own purposes or those of third parties, the concept, technologies, know-how, elements protected by copyright or intellectual property, or any other element of the site.
13.18 It is strictly prohibited to interrupt, suspend, slow down or prevent the continuity of the Services, to attempt to intrude into the systems or databases of DS PRODUCTION and DS FORMATION, or to undermine security and authentication measures, in particular by sharing login credentials with third parties.
13.19 It is strictly prohibited to monetize, sell or transfer all or part of access to the Services or to the information hosted therein.
13.20 Any practice aimed at misusing the Services, as well as any breach of the obligations in this article 13, will be subject to systematic legal proceedings.
13.21 Prior to any legal proceedings, the publisher may take protective measures, including the suspension or termination of access to the Services for the Client who is the author of or accessory to the breach, the removal of published content, the notification of other users and, where applicable, referral to the competent authorities.
14.1 The publisher undertakes to provide the Services with reasonable diligence, it being specified that it is subject to a best-efforts obligation, which the client accepts.
14.2 The publisher has no knowledge of Content posted online by Clients as part of the Services, over which it exercises no moderation, selection, verification or control.
14.3 The publisher cannot be held liable for Content authored by third parties; any claim must first be directed to the author of the Content in question.
14.4 The publisher reserves the right to temporarily interrupt access to the Services for maintenance reasons, without its liability being engaged as a result of any temporary difficulties or inability to access that this may cause.
14.5 The publisher, as author of the content of the service offered, subjects it to ongoing research and continuous revision; its liability cannot be engaged in the event of any imperfection.
14.6 The publisher's liability is limited to direct faults actually causing harm actually suffered by the client.
14.7 Bonuses offered as part of DS FORMATION programs are valid for 1 year from the date the training was purchased. Bonuses not claimed or used within this period are forfeited.
14.8 Depending on the support programs chosen, in the event of failing the certification offered, a further attempt may be requested; any additional certification attempt is charged at 60 euros, payable before taking it.
15.1 Acceptance of these Terms of Sale constitutes, absent written notice to the contrary sent to the publisher, authorization for video and photographic recording in connection with in-person events (seminars, conventions, masterminds, masterclasses, etc.) openly covered by an audiovisual production team.
15.2 By confirming their order for such an event, the client authorizes, free of charge, DS PRODUCTION and DS FORMATION to use photographs taken of them during the event, to record their filmed participation (image and/or sound) in connection with the event or a studio recording, to incorporate it into any recording made before or after, and to exploit this participation, in whole or in part, on any medium and by any means of distribution known or unknown to date, worldwide.
15.3 The client acknowledges having been fully compensated for these rights and may not claim any remuneration for the use thus authorized, nor request the forfeiture of these rights, as long as such use is neither defamatory nor objectively harmful.
15.4 For any extended commercial use of their image beyond simple coverage of the event (advertising, communication campaigns, social media for promotional purposes), the publisher may request a specific and separate authorization from the client, via a dedicated form. This additional authorization is in addition to that in article 15.1 and does not replace it.
The publisher reserves the right to insert, on any page of the site and in any communication to Clients, advertising or promotional messages, in any form whatsoever.
17.1 The publisher cannot be held liable for the technical availability of websites or mobile applications operated by third parties, including any partners, which the Client may access via the Services or through a direct recommendation.
17.2 The publisher assumes no liability for the content, advertisements, products or services available on these third-party sites and applications, which are governed by their own terms of use.
17.3 The publisher is likewise not responsible for transactions between the Client and an advertiser, professional or merchant to whom the Client may be directed through it, and cannot be party to any dispute with such third parties, in particular relating to the delivery of products or services, warranties or any other obligation between them.
18.1 The Client declares having the skills and technical means necessary to access the online training platform and benefit from the courses or services offered.
18.2 For online services, the Client must have suitable computer equipment (computer, tablet or smartphone with a sound card and speakers), a screen, an internet connection, a web browser and email software. No specific minimum configuration is required.
18.3 For in-person services (seminar, masterclass, mastermind, etc.), unless otherwise provided, it is the Client's responsibility to arrange and pay for their own transport and accommodation.
19.1 DS PRODUCTION and DS FORMATION process their clients' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and French law n° 78-17 of January 6, 1978, as amended. The data collected (last name, first name, email address, postal address) is used for order management and sending commercial information. It is not transferred to third parties, except for the technical service providers necessary to perform the service (Stripe, Learnybox, Hostinger) and statistical analysis tools (Google Analytics, Facebook pixel), which are subject to their own privacy policies.

20.1 The site collects statistical data via Google Analytics and the Facebook pixel. This data is used solely by the publishing company and is never resold to third parties.
20.2 The data collected relates to last name, first name, email address and postal address.
20.3 The information collected is used to respond to client requests and, for commercial purposes, to send them information about the publisher's offers.

All disputes relating to the validity, interpretation, performance, termination or consequences of these terms, which have not been resolved amicably, will be submitted to French law and to the courts of the city of BOURGES (France).
